The widow of Anastasio, Maria Puga, and the attorneys representing the family are in Mexico City to elevate this landmark case and the hearing convened  by the Inter-American Commission on Human Rights (IACHR) on November 4th 2022. The IACHR will determine whether United States law enforcement officials killed Anastasio Hernández Rojas, orchestrated a cover up, and denied the family access to justice. This emblematic case is the first involving a killing by U.S. law enforcement to be opened by the IACHR and will set a precedent for those that follow.

This is a pivotal moment in the case. The U.S. government has asked the Inter-American Commission to close the hearing to the public. Today, the family responded to the Commission insisting on a public hearing on the merits. In the words of Maria, “They killed Anastasio in public, they should answer for it in public.”  

The family will hold a press conference TOMORROW, October 25th, 2022 in Mexico City at 11:00 am Central Time (9:00 am Pacific Time) to speak about their search for justice for Anastasio, who was a longtime resident of San Diego originating from San Luis Potosi, Mexico. He is one of many people killed by the nation’s largest law enforcement agency, Customs and Border Protection (CBP), whose officials have never been convicted for their killing while on duty. The majority of those killed are Mexican nationals. Details provided in the Spanish-language press release below.

a la Conferencia de Prensa en la Ciudad de México:
“12 años en busca de justicia para Anastasio Hernández Rojas”

El 28 de mayo de 2010, Anastasio Hernández Rojas, quien intentaba regresar a su hogar en San Diego desde México para encontrarse con su pareja y cinco hijos, fue detenido por miembros de la Patrulla Fronteriza de los Estados Unidos, quienes lo lastimaron. Cuando Anastasio pidió asistencia médica, se la negaron y lo llevaron a una estación para ser deportado a México. Ahí, frente a varios testigos, los oficiales lo golpearon brutalmente, le quitaron sus pantalones y le dispararon con una pistola eléctrica mientras yacía en el suelo esposado boca abajo, hasta que dejó de respirar. Cuando llegó al hospital, tenía muerte cerebral y había sufrido un infarto, y varias lesiones graves. Falleció días después.

Hoy, tras 12 años de lucha, su familia está cada vez más cerca de obtener justicia: la Comisión Interamericana de Derechos Humanos (CIDH) realizará una audiencia el próximo 4 de noviembre para determinar si los funcionarios estadounidenses encargados de hacer cumplir la ley utilizaron el poder del Estado para matar a Anastasio, encubrir el crimen y negar a su familia el acceso a la justicia. El caso de Hernández Rojas es el primero de ejecución extrajudicial cometida por las fuerzas policiacas estadounidense que llega a un árbitro.
