November 7, 2022 — On Friday, the Inter-American Commission on Human Rights (IACHR) heard testimony from the family of Anastasio Hernández Rojas, who was a longtime San Diego resident until border agents tortured and killed him on May 28, 2010 in front of dozens of people without any consequence, leaving his family without justice. This is the first case opened against the United States for an extrajudicial killing.

During the hearing, Maria Puga, Anastasio’s widow and the petitioner in the case, delivered powerful testimony about the devastating timeline of events surrounding the brutal torture and killing of her husband, the impact of his death on her family, and the total denial of justice. The hearing also included the testimony of a former Mexican government official who was on duty at the time of the incident and gave damning testimony about what he witnessed. 

This testimony was buttressed by compelling evidence and arguments presented by the family’s attorneys, Roxanna Altholz from Berkeley Law and Andrea Guerrero from Alliance San Diego. Instead of responding to grave allegations of human rights violations — the torture and killing of Anastasio, the coverup of evidence, and the denial of justice to the family — the United States instead insisted that the Commission dismiss the case. They did not answer any of the questions posed by the Commissioners — none — including whether the United States recognized the international prohibition of torture. 

The parties now have 30 days to respond in writing to the questions posed by Commissioners and provide additional evidence in the case. The IACHR will then take the case into final deliberation before issuing a decision, most likely in 2023.  

Roxanna Altholz, Co-Director of the International Human Rights Law Clinic at UC Berkeley and attorney in the Anastasio case said:

The hearing was a historic opportunity for an independent and impartial body to examine the laws and institutions that foster violence and impunity in the United States. We presented overwhelming evidence that the United States committed grave human rights violations. Unfortunately, the United States refused to respond to our serious allegations that U.S. law enforcement tortured and killed an unarmed Latino man, and then orchestrated a cover-up. The United States’ indifference to its international human rights obligations and the family’s right to truth and accountability demonstrates how far we have to go to achieve racial justice in this country. We urge the Commission to condemn the United States in the strongest possible terms.

Maria Puga, Anastasio’s widow and the petitioner in this case said:

I still hear the cries of my husband calling for help. No one deserves to be treated the way Anastasio was treated. He was a human being. The border agents who killed him must have thought he didn’t have a family or a community. They were wrong. Here we are, and we will fight for justice for Anastasio and all of the other victims of border agents until the system changes. I don’t want the government’s sympathy, I want their apology, and I want the abuse and the killing to stop. I am asking that the Commission instruct the United States to publicly acknowledge what they did to my husband, reopen the investigation, and change policies so no other family has to suffer what my family has suffered. 

Andrea Guerrero, Executive Director of Alliance San Diego and attorney in the Anastasio case said:

CBP is the most powerful, most abusive, and least accountable law enforcement agency in the country. Since Anastasio’s death, nearly 250 more people have died in an encounter with border agents, and no agent has been held responsible. In fact, in the near 100 year history of Border Patrol, no agent has ever been convicted for killing someone. Now use of force by border agents is on the rise with an average of 3 incidents a day, according to their own data, with little to no accountability. Given the scale of the agency, the scale of abuse, and the scale of impunity, CBP poses the greatest threat to human rights in the United States. Now is the moment for the American public and the world of nations to ask the hard questions about why border agents have been able to get away with so much for so long, abusing and killing its own citizens, as well as migrants and travelers from all over the globe. Now is the time for the Inter-American Commission to hold the United States to account for its actions.

7 de noviembre de 2022 — El viernes pasado, la Comisión Interamericana de Derechos Humanos (CIDH) escuchó el testimonio de la familia de Anastasio Hernández Rojas, quien residió en San Diego durante mucho tiempo hasta que agentes fronterizos lo torturaron y asesinaron el 28 de mayo de 2010 frente a decenas de personas sin ninguna consecuencia, dejando a su familia sin justicia. Este es el primer caso abierto contra Estados Unidos por una ejecución extrajudicial.

Durante la audiencia, María Puga, la viuda de Anastasio y peticionaria en el caso, brindó un poderoso testimonio sobre la devastadora cronología de los eventos que rodearon la brutal tortura y el asesinato de su esposo, el impacto de su muerte de ella en su familia y la total denegación de justicia. La audiencia también incluyó el testimonio de un ex funcionario del gobierno mexicano que estaba de servicio en el momento del incidente y dio un testimonio condenatorio sobre lo que presenció.

Este testimonio fue respaldado por pruebas convincentes y argumentos presentados por los abogados de la familia, Roxanna Altholz de Berkeley Law y Andrea Guerrero de Alliance San Diego. Maria Puga, viuda de Anastasio y peticionaria en este caso dijo:

Todavía escucho los gritos de mi esposo pidiendo ayuda. Nadie merece ser tratado como fue tratado Anastasio. Él era un ser humano. Los agentes fronterizos que lo mataron debieron pensar que no tenía familia ni comunidad. Ellos estaban equivocados. Aquí estamos, y lucharemos por justicia para Anastasio y todas las demás víctimas de los agentes fronterizos hasta que cambie el sistema. No quiero la simpatía del gobierno, quiero sus disculpas y quiero que cesen los abusos y las matanzas. Estoy pidiendo que la Comisión instruya a los Estados Unidos a reconocer públicamente lo que le hicieron a mi esposo, reabrir la investigación y cambiar las políticas para que ninguna otra familia tenga que sufrir lo que mi familia ha sufrido.

Andrea Guerrero, Directora Ejecutiva de Alliance San Diego y abogada en el caso de Anastasio dijo:

CBP es la agencia policial más poderosa, más abusiva y menos responsable del país. Desde la muerte de Anastasio, casi 250 personas más han muerto en un encuentro con agentes fronterizos y ningún agente ha sido responsabilizado. De hecho, en los casi 100 años de historia de la Patrulla Fronteriza, ningún agente ha sido condenado por matar a alguien. Ahora, el uso de la fuerza por parte de los agentes fronterizos va en aumento con un promedio de 3 incidentes por día, según sus propios datos, con poca o ninguna rendición de cuentas. Dada la escala de la agencia, la escala del abuso y la escala de la impunidad, CBP representa la mayor amenaza para los derechos humanos en los Estados Unidos. Ahora es el momento para que el público estadounidense y el mundo de las naciones hagan preguntas difíciles sobre por qué los agentes fronterizos han podido salirse con la suya durante tanto tiempo, abusando y matando a sus propios ciudadanos, así como a migrantes y viajeros de todas partes del mundo. Ahora es el momento de que la Comisión Interamericana haga que Estados Unidos rinda cuentas por sus acciones.
