SAN DIEGO — As the Supreme Court greenlights the Trump administration to restart its egregious racial profiling in the greater Los Angeles area, Alliance San Diego is calling on the community here to prepare and for congressional leaders to act. On Monday, the Court signaled that immigration agents could justify detaining a person to ask them to prove their immigration status based on any of these criteria in any combination: they look Latino, speak Spanish (or English with an accent), or are in a location or working a type of job that the federal agents associate with immigrants. 

That is racial profiling, pure and simple. If federal agents are allowed to engage in it in Los Angeles, they could just as easily engage in it in San Diego and across California. If they can target Latinos, they can target any group of people they stereotype as immigrants. Alliance San Diego is encouraging the community to be vigilant and to prepare. 

“The most important thing right now is for people to understand what they should say or do if they or someone around them are racially profiled and approached by a federal immigration agent,” said Michelle Celleri, Legal Rights Director for Alliance San Diego. “Regardless of whether you are a citizen or not, this knowledge is power and can help you and your loved ones assert your dignity.”

Alliance San Diego calls on federal lawmakers to strengthen protections for our community. Unlike in California, which passed the Racial and Identity Profiling Act in 2015, there is no federal law prohibiting racial profiling. In the absence of federal law, the Supreme Court is interpreting the Fourth Amendment of the Constitution as providing limited protections against profiling. It is not enough. Congress must act. 

“We need Congress to pass federal law that explicitly prohibits racial and identity profiling like we do in California,” said Andrea Guerrero, Executive Director of Alliance San Diego and Co-Chair of the California Racial and Identity Profiling Advisory Board. “The Supreme Court essentially just gave federal agents a hall pass to conduct racial profiling in our communities. We need our elected leaders to step up and act to protect the dignity and rights of our families.”

California is a place of immigrants, where one out of every two children in the state is born to an immigrant. California is also rich in diversity with an ethnic plurality made up of a population that is 40% Latino. Because of this, California has become a target of the Trump administration’s aggressive and dehumanizing tactics that we cannot allow to be normalized.

SAN DIEGO — Mientras la Corte Suprema permite a la administración Trump a reiniciar su grave práctica de perfil racial en el área metropolitana de Los Angeles, Alliance San Diego hace un llamado a la comunidad local a prepararse y a los líderes del Congreso a tomar acción. El lunes, la Corte indicó que los agentes de inmigración pueden justificar la detención de una persona para pedirle que demuestre su estatus migratorio basándose en cualquier combinación de los siguientes criterios: que aparenten ser latinos, que hablen español (o inglés con acento), o que se encuentren en un lugar o trabajen en un empleo que los agentes federales asocien con personas inmigrantes. 

Eso es perfil racial, puro y simple. Si a los agentes federales se les permite hacerlo en Los Angeles, también podrían hacerlo en San Diego y en todo California. Si pueden enfocarse en los latinos, pueden enfocarse en cualquier grupo de personas que ellos estereotipan como inmigrantes. Alliance San Diego anima a la comunidad a estar alerta y a prepararse. 

“Lo más importante en este momento es que la gente entienda qué debe decir o hacer si ellos, o alguien a su alrededor, están sujetoss a perfiles raciales y se les acerca un agente federal de inmigración,” dijo Michelle Celleri, Directora de Derechos Legales de Alliance San Diego. “Sin importar si eres ciudadano o no, este conocimiento es poder y puede ayudarte a ti y a tus seres queridos a defender su dignidad.”

Alliance San Diego pide a los legisladores federales que fortalezcan las protecciones para nuestra comunidad. A diferencia de California, que aprobó la Ley de Perfil Racial e Identidad en 2015, no existe una ley federal que prohíbe el perfil racial. En ausencia de una ley federal, la Corte Suprema está interpretando la Cuarta Enmienda de la Constitución como una protección limitada contra el perfil racial. No es suficiente. El Congreso debe actuar. 

“Necesitamos que el Congreso apruebe una ley federal que prohíba claramente el perfil racial y de identidad, como lo hacemos en California,” dijo Andrea Guerrero, Directora Ejecutiva de Alliance San Diego y Copresidenta de la Junta Asesora de Perfil Racial e Identidad de California. “La Corte Suprema básicamente acaba de dar a los agentes federales un pase libre para practicar el perfil racial en nuestras comunidades. Necesitamos que nuestros líderes electos actúen para proteger la dignidad y los derechos de nuestras familias.”

California también es diversa, con una pluralidad étnica formada por una población que es 40% latina.
